Sheriff Darren Campbell stated: On Wednesday, December 6, 2023, a narcotics investigation concluded with the arrest of Brian Dean McGarity, for Felony Possession with Intent to Sell or Deliver Methamphetamine, Felony Possession of Fentanyl, Misdemeanor Drug Paraphernalia, and Absconding Probation Warrants.
This investigation began after numerous citizen complaints were received about illegal drug activity occurring in the area of the Best-In-Town Motel on West Front Street in Statesville.
Iredell County Sheriff’s Office Narcotics Detectives along with members of the Iredell County Sheriff’s Office Aggressive Criminal Enforcement (ACE) Team conducted surveillance in the area to verify the information. Based upon this information deputies conducted a traffic stop on a vehicle. Once a search of the vehicle was conducted the deputies located approximately 26.70 Grams of Methamphetamine and 1.30 Grams of Fentanyl with a combined street value of approximately 2,200.00 dollars.
On initial questioning, one occupant in the vehicle continued to lie to the deputies about his identity. Eventually the deputies were able to determine the man’s true identity as Brian Dean McGarity. Through a criminal records search, McGarity was found to have several active warrants for his arrest for absconding probation.
McGarity was arrested and transported to the Iredell County Detention Center where he was charged with Felony Possession with Intent to Sell or Deliver Methamphetamine, Felony Possession of Fentanyl, Misdemeanor Drug Paraphernalia, and Absconding Probation Warrants. McGarity appeared before Magistrate Callejas who issued a 176,000.000 dollar secured bond on those charges.
As the investigation continued into McGarity, narcotics detectives seized a cell phone belonging to McGarity and obtained a search warrant to process it.
While reviewing digital evidence from the phone, the investigators discovered numerous items of child pornography. The narcotics detectives immediately contacted detectives with the Iredell County Sheriff’s Office Special Victim’s Unit, and a separate investigation began.
Special Victim’s Unit Detectives located numerous images of child sexual assault material on McGarity’s phone. As a result of this investigation, McGarity was additionally charged with Ten Counts of Felony Second Degree Sexual Exploitation of a Minor. Magistrate Chambers issued an additional 75,000.00 dollar secured bond on these charges.
